Nevada Payday Loan Laws ? I have a question in regards to payday companies. Do they have to be filed as a business and what are the laws on electronic signature loans? I am having a problem with a pro-claimed business with a loan. I am not aware of Nevada laws on electronic signature loans. Which I never signed or faxed, in fact I only electronically signed and noticed I was never approved at that time of the process. Later on about a month I get a phone call saying they gave me a loan and I owe them money. I did not check my other account as it was an older one which I was going to close. Anyways, after speaking to them I noticed in my Spam folder they sent a letter stating: “In order to approve your loan, you need to sign and fax back the attached form. Please print out, sign, and fax the form back to the fax number found on your documents.” After reading it, I said to myself I never signed (pen-paper) or faxed it. They pretty much sent the loan straight to my old account. I called my bank and got a statement, so apparently the amount of $200.00 dollars was deposited in, however the next day it was taken out by some merchant. I called that merchant and it seems to be a pattern that when you sign up for the loan your signing up for more. I did an entity search on the State of Nevada website and I could not find any information about this payday company.

any lawyers familier with the payday loan laws that just went in effect in July for Oregon? my question is i been paying off a payday loan from the cash store through a 3rd party collection agency for about 9 months at 100 dollars a month then I fine out that in early August my account was sent back to "The Cash store" I noticed it was the same time frame that alot of the companies in Oregon gave up there license to do business in Oregon cause of the new laws that went in effect in Oregon on July 1st. Now I cant get a hold of anyone from the company to ask whats going on. I owed 435 dollars lefted of about a 1000 dollar original balance. Do you think they just charged off the remaining balance?

The new laws that went into effect probably will not change the debt you incurred before the law change. The law change mostly limits the interest that these companies can charge from now on and that a certain amount has to be paid each month without rolling the loan over. There are also new requirements to boldly display the annual interest rate on the wall of the business. These changes have made it unprofitable for most companies to maintain their leases into the future. Since you already owe the money I would expect that these cash strapped companies will be even more agressive in collecting the past due amounts they already have on their books. Sorry for the bad news..I've been screwed by them as well. Can only be happy that many more will not suffer the same fate."

SmartA$$ replied: "They are using scare tactics to try to get you to pay up, they're hoping you don't know any better. They cannot have you arrested unless they can prove that you committed fraud. Failure to repay is not fraud as long as you didn't lie on your loan application. although they cannot have you arrested, they can and will make your life hell until you repay. They can eventually sue you for the unpaid balance including all the interest and penalties they tack on. When they sue you the court will issue a judgment against you. If you don't pay the judgment the loan company can ask the court to garnish your wages or put liens on your personal property if your state's laws allow. The end result boils down to the fact that you do owe them money, so sooner or later you're going to have to pay them."

Anybody know anything about Westbury Ventures??? Has anyone dealt with this company. They are payday loan company and I defaulted on payment. So I tried to set up a payment plan and they refused. Now they are trying to add all these charges. They keep harassing me at work. I work for a law firm so I had one of the lawyers tell him to kindly quit calling we don't accept debt collection calls. Well, you see I put stop payments on that company and they are mad. I have now asked for a detailed bill. I took out a 300.00 loan and they are claiming I owe 960.00. I have already paid them 180.00 since October. How can I get them to leave me alone. How can I set up a payment plan when they refuse to give me a detailed bill and information to mail it to. I was at a payday loan place, but come to find out I took out an installment loan. I lost my job and my payment was due Monday. I told them what happened but they wouldn't make arrangements with me. Today they called me threatening to take me to court. I know that I'm not protected by the payday loan laws. I read something about CILA. What can I do? They won't work with me. They want all or nothing. I was laid off and it's taking me a while to find a job. I am not trying to dodge them, I just can't pay it all back right now. Is my only option to let them take me to court?

If they take you to court go and explain you are having hardships to the judge. They can not garnish wages that you don't have!"
